Toezicht accountants frustreert autoriteiten in en buiten Europa

Zowel Europese als Amerikaanse toezichthouders klagen over het gebrek aan toezicht op internationale accountantskantoren. Vandaag pleitte voorzitter Steven Maijoor van het International Forum of Independend Audit Regulators (IFIAR) op een internationale conferentie voor een aparte Europese toezichthouder voor accountants.

Maijoor, tevens directeur bij de AFM, verwees in zijn pleidooi naar de internationale rol van accountantskantoren. Daarop is sluitend toezicht nauwelijks mogelijk vanuit nationale toezichthouders, aldus Maijoor. Maar nodig is het wel, zo zei hij op een conferentie van de Europese Commissie over internationale ontwikkelingen in de accountancy.

"The need for this step is obvious: auditing is one of the most important pillars for well-functioning banking, insurance and securities markets. And as mentioned above, serious extra-territorial issues are inherent in the oversight of internationally active audit firms. International cooperation needs to respond to these extra-territorial issues. Therefore, the EAA should be given the responsibility for the authorization and supervision of certain audit firms with pan-European reach."

Daarnaast wil Maijoor voorkomen dat accountants die ook in de VS werken zich schuldig maken aan wetsovertredingen door te weigeren bepaalde informatie over te dragen aan buitenlandse toezichthouders. Dit is nu verboden door nationale wetgevingen. Een Europese toezichthouder kan het hiaat in het internationaal toezicht dichten.

"If they want to provide confidential information they need to violate their national legislation based on the Statutory Audit Directive. US audit firms with clients listed in the EU have similar problems. This implies that audit firms need to make a choice which legislation to violate. Bringing organizations that we supervise in a position that they need to violate a law is against one of the fundamental objectives we try to achieve as regulators."

"Dit was een mooie gelegenheid om dit pleidooi te houden", aldus woordvoerster Imre de Roo van de AFM. "Het is een bijeenkomst van de Europese Commissie voor toezichthouders uit de hele wereld."

Ze betwijfelt of een Europese toezichthouder voor de accountancy er snel zal komen. "Er zijn nu voorstellen voor Europese toezichthouders voor banken, verzekeraars en de effectenhandel. Over de invoering daarvan is nog geen duidelijkheid. Voordat er een Europese toezichthouder komt voor accountants, zijn we veel verder."

Maijoors pleidooi komt op een moment dat de PCAOB, de Amerikaanse toezichthouder op accountants, constateert dat zij er niet in slaagt om accountantskantoren in het buitenland te controleren die werken voor Amerikaanse beursfondsen in het buitenland. In Nederland gaat het volgens de PCAOB om KPMG en PwC.

"No PCAOB inspections have been completed even though more than four years have passed since the end of the calendar year in which they first issued an audit report while registered with the PCAOB", zo meldt de PCAOB op haar website.
